Sammy S. Nabulsi, a partner at Rose Law Partners LLP, appeared before the Supreme Judicial Court on April 8, 2026, on behalf of Mayor Wu and the City of Boston, representing all appellees in Emerald Necklace Conservancy v. City of Boston, et al.
The appeal centers primarily on whether the trial court correctly concluded that the Stadium Parcel is not protected by Article 97 of the Massachusetts Constitution, which safeguards designated open space. In April 2025, Attorney Nabulsi and the appellees prevailed in Suffolk Superior Court, which ruled that Article 97 did not apply to the parcel on which White Stadium is located because its designation as parkland had been extinguished by prior legislative action. The Supreme Judicial Court will also consider whether the trial court correctly determined that plaintiffs lacked standing on certain counts and whether the court properly excluded evidence pursuant to motions in limine.
